General Terms and Conditions (GTCs) for accommodation in the holiday home EulenHorst & EulenNest
1. Scope
These General Terms and Conditions (GTCs) apply to all contracts for the rental of the holiday home EulenHorst and EulenNest as well as to all related services concluded between the landlord (the Ohlenforst family) and the guest.
2. Booking and conclusion of contract
2.1. The holiday home can be booked in writing, by email, or via an online booking portal. 2.2. The rental agreement is concluded upon the landlord's booking confirmation, which is sent to the guest in writing or electronically. 2.3. The guest is obligated to check the booking confirmation for accuracy and to report any discrepancies immediately.
3. Rental price and payment conditions
3.1. The rental price includes the use of the holiday home and the additional services listed in the booking confirmation (e.g., final cleaning, bed linen). 3.2. A deposit of 20% of the rental price is due within 7 days of receiving the booking confirmation. The remaining amount is due no later than 21 days before departure. No deposit is required.
3.3. For short-term bookings less than 21 days before departure, the entire rental price is due immediately. 3.4. Payments must be made by bank transfer to the account specified in the booking confirmation. 3.5. In case of late payment, the landlord reserves the right to terminate the contract and demand compensation.
4. Due diligence obligations
4.1. The tenant is obligated to treat the rental premises and furnishings with care. Any damage caused must be reported and replaced immediately by the tenant. 4.2. Upon moving into the premises, tenants must check the furnishings for completeness and usability. Any defects or damage must be reported to the landlord immediately. 4.3. Damage occurring during the rental period must also be reported immediately. If tenants fail to comply with this obligation to report, they are not entitled to a rent reduction for these objectionable points. 4.4. The landlord is entitled to reasonable compensation if unreported damage is discovered after the stay. 4.5. The holiday home may only be used by the number of people stated in the booking. Overcrowding is not permitted. 4.6. Pets are only permitted with the express consent of the landlord. The cost per pet is €12 per day. (Maximum two dogs) 4.7. Smoking is not permitted in the holiday home. 4.8. The use of the holiday home for commercial or other non-tourist purposes is prohibited. Parties of any kind, such as bachelor/bachelorette parties, are not permitted.
5. Arrival and departure
5.1. The holiday home is available from 4:00 PM on the day of arrival. 5.2. On the day of departure, the holiday home must be vacated by 10:00 AM at the latest. 5.3. A later departure is only possible after prior arrangement with the landlord.
6. Cancellation conditions
6.1. The tenant may withdraw from the rental agreement at any time prior to departure. The withdrawal must be made in writing. 6.2. In the event of withdrawal, the following cancellation fees apply:
Flexi – Cancellation conditions:
- Free cancellation up to 14 days before arrival
- Cancellation within 14 days before arrival: 20% of the rental price
- Cancellation on the day of arrival: 90% of the rental price
6.3. The landlord recommends taking out travel cancellation insurance. 6.4. The landlord may withdraw from the contract if the tenant breaches essential contractual obligations or fails to make payment on time. In this case, the landlord's claim to the rental price remains valid.
7. Liability
7.1. The landlord is only liable for defects in the holiday home in cases of gross negligence or intent. 7.2. The guest is liable for all damages caused by him or her or fellow travelers during the rental period. 7.3. The landlord is not liable for loss or damage to the guest's property unless this is due to gross negligence or intent on the part of the landlord.
9. Data protection
The personal data provided by the guest will be processed exclusively for the purpose of processing the booking and in accordance with applicable data protection regulations. Further information can be found in the landlord's privacy policy.
10. Final provisions
10.1. Changes or additions to the contract must be made in writing. 10.2. By signing the booking confirmation or rental agreement, the tenant confirms that they have valid liability insurance and have read and understood all provisions of the booking confirmation, rental agreement, house rules, and the information in the booking and guest folder. 10.3. The law of the Republic of Austria applies. 10.4. The place of jurisdiction is Spittal an der Drau, to the extent permitted by law. 10.5. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
